Agreement to these terms
These Terms of Use (“Terms”) apply to mobile apps, websites, and related services provided by Brightgrain LLC (“Brightgrain,” “we,” “us,” or “our”), including Hypothetically Speaking, ThreadCircle, and Caribbean Seesaw. By downloading, accessing, or using a Brightgrain app or service, you agree to these Terms. If you do not agree, do not use the app or service.
Eligibility
You must be legally able to enter into these Terms. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf.
License to use our apps
Brightgrain grants you a limited, personal, non-exclusive, non-transferable, revocable license to use our apps and services for their intended purposes, subject to these Terms and applicable App Store rules. Brightgrain and its licensors retain all rights not expressly granted to you.
Accounts and invitations
Some features may require an account, invitation, or join code. You are responsible for keeping your access information secure and for activity associated with your account or invitation. Do not share private invitation links or codes with people who are not intended participants. Tell us promptly if you believe your account or access information has been compromised.
User content and shared features
You retain ownership of content you submit through our services. You give Brightgrain a limited license to host, store, process, display, and transmit that content only as reasonably necessary to operate, maintain, and improve the applicable service. Content placed in a shared group, circle, or game may be visible to other participants in that space.
You are responsible for your content and must have the rights needed to submit it. Do not submit unlawful, harmful, infringing, deceptive, abusive, or privacy-violating content.
Acceptable use
You may not misuse our apps or services. This includes attempting to disrupt or bypass security; accessing another person’s account without permission; reverse engineering except where applicable law expressly permits it; using automated systems to scrape or overload a service; or using a service for unlawful, fraudulent, or abusive activity.
App Store terms
If you downloaded an app through Apple’s App Store, your use is also subject to Apple’s applicable terms. Apple is not responsible for providing maintenance or support for Brightgrain apps. To the extent these Terms conflict with mandatory App Store terms, the mandatory App Store terms control.
Availability and changes
We may add, change, suspend, or discontinue features or services. We do not promise that every feature will always be available, uninterrupted, secure, or error-free. Features described as coming soon or in development may change and may not be released.
Intellectual property
Our apps, services, branding, designs, software, and original content are owned by Brightgrain or its licensors and are protected by applicable intellectual-property laws. These Terms do not permit you to use Brightgrain names, logos, or other brand features without prior written permission.
Third-party services
Our apps may rely on or link to third-party services. Brightgrain does not control and is not responsible for third-party services, content, policies, or availability. Your use of a third-party service may be governed by separate terms.
Disclaimer
To the fullest extent permitted by law, our apps and services are provided “as is” and “as available,” without warranties of any kind, express or implied. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
Limitation of liability
To the fullest extent permitted by law, Brightgrain and its members, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of—or inability to use—our apps or services. These limitations do not apply where prohibited by law.
Suspension and termination
You may stop using our apps at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or misuse a service. Provisions that by their nature should survive termination will remain in effect.
Privacy
Our Privacy Policy explains how we handle information in connection with our apps, website, and services.
Changes to these terms
We may update these Terms as our apps or practices change. We will post the revised Terms here and update the date at the top. Your continued use after an update means you accept the revised Terms to the extent permitted by law.
